Whether or not you have to reimburse your health insurance depends largely on whether or not your insurance is governed by state or federal law. In Washington, you are required to reimburse your health insurance (depending on the terms of your contract) from the proceeds of a settlement with the at-fault party. However, the Washington Supreme Court has ruled that if you have not been fully compensated for your injuries, your health insurance has no right of recovery. On the other hand, if your health insurance is governed by a federal law called ERISA, you may have to reimburse your health insurance 100% of payments made, whether or not you have received full compensation.
